City sues Beans

The City of Port Lavaca has sued a San Antonio couple for allegedly encroaching on property belonging to the city.

The lawsuit seeks a declaratory judgment in Calhoun County Court against Al and Vicky Bean.

The suit says the Beans erected improvements on Front Street, which is city property. It says the defendants purchased a lot adjacent to Front Street in 2007 “but are currently claiming that they own Front Street which was never conveyed to them.”

The suit seeks a ruling ordering the Beans to remove all improvements or belongings placed on the property, pay attorney fees and court costs and “further relief to which plaintiff may be entitled.”


Documents attached to the suit include a survey showing a .45-acre plot bounded by Commerce, Main and Front streets and a contract for deed showing the Beans made a $1,000 down payment on April 1, 2007, for property at 116 N. Commerce to Dennis and Bertha Harvey.

“I haven’t built on Front Street,” Al Bean said Monday by telephone from San Antonio. “The city has been charging taxes on land it didn’t own.

“The planters are on disputed property that’s never been claimed,” Bean said. “It’ll all be settled in the end.”

The city is being represented by David Griffin of Marek, Griffin and Knaupp. The suit was filed May 21.
