Port Lavaca council decides not to annex

The Port Lavaca City Council agreed Monday night not to annex a sparsely populated area along FM 1090 south of the city limits.

Several property owners in the area, which totals 142 acres in tracts on both sides of FM 1090 where it extends south from Virginia Street, submitted requests to speak during the public hearing.

They approved when the council members’ discussion indicated little support for the proposal.

“This is not helping the city,” Councilman Raymond Perez said.


“In this case we are not going to give them immediate city services,” Councilman Lee Rivera added.

Councilman Tom Innes said the 16 homes in the area wouldn’t have city fire protection after Dec. 31, when an agreement for city firefighters to respond to fires in unincorporated parts of the county expires. He said some communities have programs in which residents can subscribe for fire protection.

Mayor Jack Whitlow said the plan was developed with the expectation of future development, and that it could be considered again in the future.

After the public hearing was closed, council members unanimously voted to “discontinue the annexation procedure.”

The final public hearing on another annexation plan drew no comments. The council is expected to vote next month to add 464 acres to the city at the request of the developers of Redfish Retreat subdivision. The area is on the west side of the FM 1090 loop from Larry Drive south to Chocolate Bay. Lots in the gated subdivision are priced at $20,000.

In other action, council members:


– Agreed to consider at their next meeting a request by Ann Smith to place a loading zone sign in front of her dance studio at 216 E. Main St. Mayor Whitlow said the city needed to talk with Texas Department of Transportation officials about loading zones, pedestrian crossing markers, handicapped parking and the speed limit on Main Street, which is also U.S. Hwy. 87.

 – Awarded a $68,770 bid by Lester Contracting Inc. to install 1,400 feet of six-inch water line with 32 connections on Tommy Drive and Charlotte Drive near W. Main Street.

– Agreed to buy two Ford Crown Victoria police cars with lights and sirens for $24,503 each, a half-ton Chevrolet pickup for animal control for $17,603, and for the fire department, a Jeep Cherokee command vehicle with light bar for $21,762 and a Ford F250 utility pickup with light bar for $21,223.

– Approved spending $43,200 to buy remote monitoring and control equipment for sewer lift stations at Half League, Brookhollow and Loop 1090 from Bloc Design-Build Corp. of Longview.

– Agreed to buy a Yazoo 72-inch zero-turn mower from Port Lavaca NAPA for $8,230.

– Approved bids of $9 a cubic yard for fill sand, $21 a ton for pea gravel and $23.50 a ton for crushed limestone from Sylva Construction, $9 a yard for top soil from Cardenas Hauling and $43 a ton for seal coat rock from Quality Hot Mix.

– Approved buying a digital sewer line camera from Indepth Utility Corp. of Stafford for $8,645.

– Waived permit fees for a parade and Martin Luther King activities at George Adams Park on Jan. 17 for Calhoun Citizens in Action.

– Presented a five-year service award to Lt. James Clark of the Fire Department and employee of the quarter award to Dorothy Cunningham of the city manager’s office.
