Krueger Construction okays county offer

Arbitration between Krueger Construction Company, contractor for the new jail and Calhoun County Commissioners’ Court came to a conclusion Monday.
Following a closed consecutive session court agreed to pay Krueger $250,000 of the $425,000 that had been in arbitration.
Kevin Krueger, president of the board, said Monday his company was agreeable with the settlement.
The arbitration with the third party of the arbitration, KBM Air Conditioning Co., is still pending. The arbitration with KBM also includes the jail architect.
KBM, subcontractor for the jail, has already been paid but is seeking damages, according to County Judge Michael Pfeifer.
“We are releasing the settlement,” Pfeifer said.
Court voted on the settlement after a brief closed executive session.
A total of $425,000, which includes interest, had been withheld from Krueger Co., contractor for the county jail, due to his failure to meet the contract completion date.
The money was withheld from Krueger for over two years.
According to the contract, the jail was to be constructed by Oct. 27, 2005. Krueger contracted with the county in April 2004 to build the jail for $6,934,000 in 480 days.
In November 2002 the voters approved a bond issue of $8.5 million to finance a 144-bed jail. The bonds were sold in June 2003.
The completion date became an issue in February 2006 when commissioners’ court noted that Krueger was behind the contract completion date by almost four months. The completion date had been pushed back to December 2005, then January 2006 and then February 2006. Inmates were first housed in the jail in mid 2006.
Don Krueger, owner of the construction company, mostly blamed the failure to meet the contract date to weather. There had been a lot of rain. Krueger also said the slow down was due to utility subcontractors.
In 2006 Krueger submitted a new completion date in writing, which was April 10, 2006. This was in time for a Texas Jail Commission inspection.
